Please read these Terms and Conditions carefully before using the Nuvio app. By using the app, you agree to these terms.
§ 1 Scope
These Terms and Conditions (T&C) apply to all contracts between the provider of the Nuvio app and its users regarding the use of the Nuvio app and its associated services. By using the app, the user agrees to these T&C.
§ 2 Contract & Registration
The Nuvio app can be used with basic functionality after downloading from the Apple App Store or Google Play Store without registration. Creating a user account is required for cloud features (online synchronization, digital product catalogue).
By registering, the user confirms that they are of legal age or have parental consent, and that the information provided is accurate.
§ 3 Scope of Services
Nuvio provides a mobile sales assistance app for iOS devices. The scope of services depends on the chosen subscription:
- Essential: Unlimited orders, product management, statistics, change calculator, offline mode
- Pro: All Essential features plus cloud synchronization across all devices, digital product catalogue, and future premium features
Nuvio is intended for internal organization and process optimization. It does not replace a certified cash register as required by law (e.g., under the German Fiscal Security Regulation or comparable national regulations). The user is solely responsible for operating a legally compliant register.
The provider reserves the right to expand, modify, or discontinue individual features. Significant changes will be communicated to the user in a timely manner within the app.
§ 4 Subscriptions, Prices & Payment
Subscriptions are concluded via the respective app store – via the Apple App Store (iOS) through in-app purchase or via the Google Play Store (Android). Billing occurs monthly in advance. Current prices are available in the app and on the Nuvio website.
Subscriptions renew automatically for the respective billing period unless cancelled at least 24 hours before the end of the current period – on iOS via iOS Settings (Apple ID → Subscriptions), on Android via the Google Play Store (Play Store → Account → Subscriptions). Billing is handled by the respective store provider (Apple or Google); their buyer policies apply for payment questions.
The app offers a 14-day free trial with full functionality. No payment method is required for the trial period.
§ 5 Right of Withdrawal
For digital content and services processed through the Apple App Store or Google Play Store, the respective withdrawal policies of Apple or Google apply. Once the download or use of a paid subscription has begun, the right of withdrawal for digital content expires pursuant to § 356 (5) BGB, provided the user has expressly consented to immediate performance.
Withdrawal requests can be made directly through Apple (Settings → Apple ID → Report a Problem) or through the Google Play Store (play.google.com → Orders → Refund).
§ 6 Cancellation
Subscriptions can be cancelled at any time at the end of the current billing period – on iOS via iOS Settings (Settings → Apple ID → Subscriptions → Nuvio), on Android via the Google Play Store (Play Store → Account → Subscriptions → Nuvio). After cancellation, access to premium features remains until the end of the paid period. The user account remains active and can be reactivated with a new subscription at any time. § 7 User Obligations
The user agrees to:
- use the app exclusively for lawful purposes
- not provide false information during registration
- not upload content that violates applicable law, third-party rights, or these T&C
- keep login credentials secure and not share them with third parties
- notify the provider immediately if unauthorized access to the account is suspected
In the event of a violation of these obligations, the provider reserves the right to temporarily suspend access to the app or delete the account.
§ 8 Digital Product Catalogue
If the user activates the digital product catalogue, they agree that their uploaded products and selected profile information will be displayed publicly. The user bears full responsibility for the content they upload. The provider reserves the right to remove content that violates applicable law or these T&C.
§ 9 Data Protection
The collection and processing of personal data is carried out in accordance with our Privacy Policy, which is available in the app and at datenschutz.nuvio.app and forms part of these T&C.
§ 10 Limitation of Liability
The provider is liable without limitation for intent and gross negligence, as well as for damages arising from injury to life, body, or health.
In cases of slight negligence, the provider is only liable for breach of a material contractual obligation (cardinal obligation); liability is limited to the foreseeable, contract-typical damage.
The provider assumes no liability for data loss caused by faulty device configuration, connectivity issues, or force majeure. Use of the app is at the user's own risk, particularly in offline mode.
§ 11 Availability
The provider strives for high availability of cloud services but does not guarantee uninterrupted availability. Maintenance work and unavoidable technical failures do not entitle the user to a reduction or refund of payments already made. The app is generally usable without an internet connection (offline mode).
§ 12 Changes to T&C
The provider reserves the right to amend these T&C. Changes will be communicated to the user at least 30 days before taking effect within the app. If the user does not object to the amended T&C within 30 days, the changes are deemed accepted. In case of objection, the user has an extraordinary right of termination.
§ 13 Applicable Law & Jurisdiction
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, the mandatory consumer protection law of the EU member state in which the user has their habitual residence additionally applies. The place of jurisdiction for merchants is the registered office of the provider.
